Terms & Conditions

1. Introduction

These Terms and Conditions (“Terms”) govern the sale of all products by Nancy’s Cakery Ltd (“we”, “us”, “our”) via our website and any related platforms. By placing an order, you (“the customer”) agree to be legally bound by these Terms.

2. Products

• All products are made to order unless otherwise stated.

• Images are for illustrative purposes only; colours, finishes, and decorations may vary.

• We reserve the right to modify or discontinue products without notice.

3. Orders and Acceptance

• All orders are subject to availability and formal acceptance by us.

• A contract is formed only once we issue written confirmation (email).

• We reserve the right to cancel any order at our sole discretion, including where pricing errors or availability issues arise.

4. Pricing and Payment

• All prices are in GBP (£) and include VAT where applicable.

• Full payment must be received before any order is processed.

• We reserve the right to correct pricing errors at any time prior to acceptance of your order.

5. Delivery (Risk & Responsibility)

• Delivery is the only fulfilment method offered.

• Delivery dates/times are estimates only and not guaranteed.

• Risk in the goods passes to you upon delivery to the address provided.

• You are responsible for ensuring accurate delivery details and that someone is available to receive the order.

• If delivery fails due to incorrect details or absence, no refund will be issued.

• We shall not be liable for delays or failure caused by circumstances beyond our reasonable control (including weather, transport disruption, or third-party couriers).

6. Perishable Goods – No Right to Cancel

• Our products are perishable and bespoke, and therefore exempt from standard cancellation rights under the Consumer Contracts Regulations 2013.

• Once production has begun, orders cannot be cancelled or refunded.

• Any refunds are issued strictly at our discretion.

7. Refunds and Complaints

• You must inspect goods upon delivery.

• Any issues (including damage or incorrect items) must be reported within 24 hours with photographic evidence.

• We reserve the right to refuse refunds where:

  • The product has been consumed or altered

  • The complaint relates to personal taste or preference

  • No evidence is provided within the required timeframe

• Our decision on refunds or replacements shall be final.

8. Allergens and Food Safety

• Our products are prepared in a kitchen that handles allergens including (but not limited to) gluten, eggs, dairy, nuts, and soy.

• We do not and cannot guarantee that any of our products are free from allergens or traces of allergens.

• Customers with allergies or dietary requirements order at their own risk.

• It is the customer’s responsibility to inform us of any allergies before ordering.

9. Custom Orders

• Custom designs must be agreed in advance.

• We do not guarantee exact replication of reference images.

• Once confirmed and production has started, no changes can be made.

10. Limitation of Liability

• To the fullest extent permitted by Scots law:

  • Our total liability shall not exceed the price paid for the order.

  • We shall not be liable for any indirect, consequential, or financial losses arising from your order or use of our products.

11. Force Majeure

We shall not be liable for any failure or delay caused by events outside our reasonable control, including but not limited to severe weather, illness, accidents, or supply chain disruption.

12. Intellectual Property

All designs, images, branding, and content remain the property of Nancy’s Cakery Ltd and may not be reproduced without prior written consent.

13. Privacy and Data Protection

We process personal data in accordance with UK data protection laws, including the UK GDPR and Data Protection Act 2018.
